Terms of Service

The commercial ground rules for working with Burvic: what we quote, when you pay, who owns what at the end, and what happens if something goes wrong. Written to be read, not to hide behind.

Who these terms apply to

These terms are between you and Burvic (“Burvic”, “we”, “us”), the web design business of Matthew Williamson, a sole trader based in Sydney, New South Wales, Australia. Burvic is not a company. ABN [TO BE COMPLETED: ABN].

They apply when you:

  • use this website, including the chat assistant and the enquiry and support forms;
  • engage us for a project or a care plan; or
  • use the client portal at /account to view or pay invoices and raise tickets.

If we have signed a separate written agreement or proposal with you, that document wins wherever it conflicts with this page. Otherwise, your accepted quote plus these terms are the whole agreement. How we handle personal information is covered separately in our Privacy Policy.

What we do

Burvic designs, builds and looks after websites for Australian businesses. Our services are:

  • Web design — custom design rather than templates.
  • Development — builds on WordPress, Shopify or a custom stack.
  • Ecommerce — Shopify and WooCommerce stores, including shipping, GST, payments and email flows.
  • SEO and content — keyword research, site structure and copywriting.
  • AI automation — assistants and automations wired into the sites we build.
  • Care plans — ongoing hosting, updates, backups, monitoring and support after launch.

Project work is sold in three packages. The exact deliverables for your job are the ones written into your quote, which always beats the summary below.

  • Launch — from $1,000 excluding GST. Up to 5 custom-designed pages, copywriting, mobile-first build, contact forms and maps, SEO fundamentals. Indicative timeline 3 to 4 weeks.
  • Grow — from $2,000 excluding GST. Up to 12 pages, keyword research and SEO copywriting, a blog or resources section, booking or enquiry workflows, editor training. Indicative timeline 4 to 6 weeks.
  • Scale — from $4,000 excluding GST. Shopify, WooCommerce or a custom stack, product, payment and shipping setup, CRM, email and inventory integrations, conversion tracking, priority support after launch. Indicative timeline 6 to 10 weeks.

Timelines are the normal range for that package and are estimates until we agree a launch date in writing at kickoff. Once agreed, that date is the one the launch guarantee below is measured against.

Quotes, prices and GST

  • Prices shown on this website are “from” prices. After a call we give you an exact fixed quote for your job.
  • All prices and quotes are in Australian dollars and exclude GST. GST is added to your invoice where it applies, so a $1,000 quote is invoiced at $1,100 including GST.
  • A fixed quote does not move. The only thing that changes it is a change to the scope, and any scope change is quoted and approved by you in writing before we start work on it.
  • Quotes are open for acceptance for [TO BE COMPLETED: quote validity period] from the date we issue them. Until that period is set and written into your quote, treat the quote as open until we tell you in writing that it has lapsed.

Third-party costs are not included in any quote, because they are yours either way: your domain name, any paid plugins or apps you choose, and any advertising spend. We tell you about these before you commit to them.

Payment

Our standard payment schedule for project work is:

  • 40% to start, before work begins.
  • 40% at design approval.
  • 20% at launch.

For Launch packages we can instead split the total into three equal monthly payments. Ask before you accept the quote.

  • Invoices are issued and paid through the client portal. Card payments are handled by Stripe. We never see or store your full card number.
  • Care plans are billed monthly in advance.
  • Invoices are due [TO BE COMPLETED: invoice payment terms, e.g. 7 or 14 days] from the date of issue. The due date on the invoice itself is the one that applies.
  • If an invoice is overdue we may pause work on your project until it is paid. We will tell you before we do, not after.
  • Interest and recovery costs on overdue accounts: [TO BE COMPLETED: late payment terms]. Until a rate is set here and agreed with you in writing, we do not charge interest or recovery costs at all.

Your part in the project

Website projects run on a schedule, and the schedule depends on both of us. You agree to:

  • give us the content, images, logos, access credentials and approvals we ask for, by the dates we agree;
  • nominate one person who can make decisions and sign things off;
  • make sure you own or are licensed to use everything you give us, including photos, logos and copy; and
  • review and respond to what we send within a reasonable time.

If material or approvals are late, the launch date moves by at least the length of the delay. A delay caused this way is not our delay for the purposes of the launch guarantee.

The launch guarantee

Every package includes our launch guarantee. If we miss the launch date we agreed in writing, and the reason is our fault, you get 10% of the total project fee back. That is 10% of the fixed quote for the project, excluding GST and third-party costs. It is credited against your final invoice, or refunded if the project is already paid in full.

The guarantee applies once per project. It does not apply where the delay is caused by:

  • late content, images, access credentials, feedback or approvals from you;
  • a change to the scope that you asked for and approved after kickoff;
  • a third party we depend on but do not control, such as your host, domain registrar, payment gateway or a plugin vendor; or
  • anything genuinely outside the reasonable control of either of us.

How to claim: email hello@burvic.com with your project name and the agreed launch date. Claim within [TO BE COMPLETED: claim window, e.g. 30 days] of the agreed launch date; until that window is set, we will not refuse a claim for being late. We will confirm in writing whether the guarantee applies, and pay or credit it within [TO BE COMPLETED: payment window for an accepted claim] — until that is set, within a reasonable time of us accepting the claim.

This guarantee is something we offer on top of your rights. It does not limit, replace or exclude any remedy you have under the Australian Consumer Law.

Who owns the website

You do, completely. The code, content, design files and accounts for your site become yours on the day the final invoice is paid. We hand over everything, we do not hold accounts or logins hostage, and we do not charge a release fee.

  • Until the final invoice is paid, ownership of the work we have produced stays with Burvic.
  • You keep ownership of everything you gave us: your brand, logos, copy, images and data. You give us permission to use those things for the purpose of building and running your site.
  • Third-party components keep their own licences. Fonts, stock images, plugins, themes and hosted services stay under whatever terms their owners set, and any ongoing fees for them are yours.
  • We keep ownership of our own general tools, code libraries, internal templates and know-how, including anything we developed before your project. Nothing stops us using that knowledge on other work.
  • Unless you ask us not to, we may show your finished site in our portfolio and case studies, and describe the work we did. Tell us if you would rather we did not and we will leave it out.

Care plans

Care plans are month-to-month subscriptions billed in advance. There are two, and these are the response times that apply:

  • Care, $50 per month excluding GST — hosting, SSL and daily backups, software and security updates, uptime monitoring, and support tickets answered by the next business day.
  • Growth, $125 per month excluding GST — everything in Care, plus 2 hours of content changes each month, SEO health checks and fixes, quarterly performance reviews, and support tickets answered the same business day.
  • Response times mean the time in which we respond to your ticket, not the time in which the issue is resolved. Business days are Monday to Friday, excluding NSW public holidays, and business hours are 9am to 5:30pm Sydney time. A ticket raised outside those hours is treated as received at the start of the next business day.
  • The Growth plan's 2 hours of content changes are per calendar month and do not roll over.
  • Care plans cover maintenance and small changes. New pages, redesigns and new features are quoted separately.
  • Anyone can open a support ticket at /support, whether or not they are on a plan. Guaranteed response times only apply to plan clients.

Cancellation

  • Care plans: cancel any time by emailing hello@burvic.com or opening a ticket. Notice required is [TO BE COMPLETED: care plan cancellation notice]; until a notice period is set, no notice is required. Your plan runs to the end of the month you have already paid for, and we do not pro-rata refund part months. If we host your site, we will help you move it.
  • Projects, cancelled by you: you pay for the work completed to that point. How the deposit already paid is treated: [TO BE COMPLETED: deposit refundability on cancellation]. Until that is set, the deposit is applied against the work actually completed and anything left over is refunded to you. We will hand over the work that has been paid for.
  • Projects, cancelled by us: we may stop work if an invoice stays unpaid, if the material you supply is unlawful or infringes someone's rights, or if the working relationship has clearly broken down. We will refund anything you have paid for work not yet done.
  • Cancelling does not wipe out anything already owed by either side.

Using this website

  • The design, text, images and code of burvic.com belong to Burvic. Do not copy or republish them without asking.
  • Do not try to break into, overload, scrape or reverse-engineer this site, its forms, its chat assistant or the client portal. We rate-limit our endpoints and we will block abuse.
  • If you have a portal account, keep your password to yourself and tell us straight away if you think it has been compromised. You are responsible for what happens under your login.
  • The chat assistant is an AI, not a person and not a quote. It can be wrong, out of date or incomplete. Nothing it says is an offer, a price or a promise, and it does not bind us. Only a written quote from Matthew Williamson does that. Messages you send it are processed by a third-party AI provider, which is explained in our Privacy Policy.
  • Case studies, statistics and testimonials on this site describe past work. They are not a promise that your project will produce the same result.

Liability, and your rights under the Australian Consumer Law

Nothing in these terms excludes, restricts or modifies any consumer guarantee, right or remedy you have under the Australian Consumer Law (Schedule 2 to the Competition and Consumer Act 2010 (Cth)) that cannot lawfully be excluded. If a guarantee under that law applies to what we supply, and we fail to meet it, you keep every remedy that law gives you. Anything below is read subject to that, and if any part of this section conflicts with it, that part simply does not apply.

You should also know how Burvic is set up, because it affects who stands behind these terms. Burvic is a sole trader, not a company, so there is no corporate structure limiting who is answerable to you. Matthew Williamson is personally responsible for the obligations in this agreement. The limits set out below are contractual limits that you and we agree to, and they only work to the extent the law allows — they are not, and do not create, the liability shield a company would have.

Subject to the paragraph on the Australian Consumer Law above:

  • Where we are permitted to do so, our liability for a failure to meet a consumer guarantee in relation to services is limited to re-supplying the services, or paying the cost of having them re-supplied.
  • Our total liability for any claim connected to a project or a care plan is limited to the fees you have paid us for that project, or for the care plan in the 12 months before the claim.
  • We are not liable for indirect or consequential loss, lost profits, lost revenue, lost data or lost business opportunity.
  • We are not responsible for third-party services we do not control, including your hosting if it is not with us, your domain registrar, payment gateways, plugins, themes or platform changes made by WordPress, Shopify or similar.
  • We are not responsible for content you supply, or for changes you or anyone else makes to the site after handover.
  • Neither of us is liable for a failure caused by something genuinely outside our reasonable control.

If something goes wrong

Talk to us first. Email hello@burvic.com or call 0405 503 114 and set out the problem. We will respond within one business day and try to sort it out directly before either of us escalates. Most things are a misunderstanding that a phone call fixes.

Changes to these terms

We may update this page. The version in force for your project is the one published when you accepted your quote, and the version in force for a care plan is the one published at the start of your current billing month. If we make a change that materially affects you, we will tell you directly. Changes to how you use this website take effect when they are published here.

Governing law

These terms are governed by the laws of New South Wales, Australia. You and we submit to the non-exclusive jurisdiction of the courts of New South Wales and the courts able to hear appeals from them. If any part of these terms is found to be unenforceable, that part is severed and the rest stays in force.
